Terms of Service

These terms apply when you use the Homes Choice website or purchase products from us.

Nothing in these terms affects your statutory consumer rights.
1. Products
We take reasonable care to ensure that product descriptions, prices, measurements and images are accurate.
Colours, finishes and natural materials may vary slightly from the images shown. You should check all product measurements and ensure that furniture will fit through doors, stairways, lifts and other access points before ordering.
2. Orders
Placing an order is an offer to purchase a product.
An automatic order confirmation only confirms that we have received your order. A contract is formed when we confirm that your order has been dispatched.
We may cancel an order before dispatch if:

the product is unavailable;

payment cannot be authorised;

we cannot deliver to your address; or
-
there is an obvious pricing or product-information error.
If we cancel an order after taking payment, we will issue a full refund.
3. Prices and payment
Prices are shown in pounds sterling and include VAT where applicable.
Delivery charges and any other compulsory costs will be shown before you place your order.
Payment must be authorised before an order is processed.
4. Supplier fulfilment
Products may be stored, prepared and delivered by third-party suppliers, warehouses or couriers on our behalf.
Your purchase contract remains with Homes Choice. We remain responsible for fulfilling your order and dealing with cancellations, refunds and problems with the goods.
Items within the same order may arrive separately.
5. Delivery
Delivery times are estimates unless we expressly agree to a guaranteed delivery date.
You must provide an accurate delivery address, telephone number and relevant access information.
You are responsible for ensuring that the product will fit into the property and that safe, reasonable access is available.
Where delivery fails because incorrect information was provided, nobody was available for an agreed delivery or suitable access was not available, we may charge the reasonable direct cost of storage, return or redelivery.
This does not apply where the failed delivery was caused by us, our supplier or our courier.

6. Returns and cancellations
Your cancellation, return and refund rights are explained in our Return and Refund Policy.
Custom-made, personalised or clearly customised products may not qualify for change-of-mind cancellation rights. This does not affect your rights where goods are faulty, damaged, incorrect or not as described.
7. Faulty goods
Products must be of satisfactory quality, fit for purpose and as described.
Contact sales@homeschoice.co.uk if an item is faulty, damaged, incomplete or incorrect.
Depending on the circumstances, you may be entitled to a repair, replacement, price reduction or refund.
8. Website use
You must not misuse the website, attempt unauthorised access, introduce malicious software or use the website for unlawful or fraudulent purposes.
Website content, branding and design belong to us or are used with permission. They must not be copied or commercially used without permission.
9. Liability
We are responsible for foreseeable loss or damage caused by our breach of these terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable or for business losses incurred by a consumer.
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, defective products or any other liability that cannot legally be excluded.
10. Events outside our control
We are not responsible for delays caused by events outside our reasonable control.
We will take reasonable steps to reduce the effect of any delay and will contact you where your order is materially affected. Your statutory rights relating to delayed delivery remain unaffected.
11. Complaints
Send complaints to sales@homeschoice.co.uk, including your name, order number and details of the problem.
We will review your complaint and respond as soon as reasonably possible.
12. Changes to these terms
We may update these terms when our services, operations or legal obligations change.
The terms applying to an order will normally be those published when the order was placed.
13. Governing law
These terms are governed by the laws of ENGLAND AND WALES / SCOTLAND / NORTHERN IRELAND.
Consumers retain any mandatory protections provided by the law of the part of the United Kingdom in which they live.
